Consentir y disponer de la vida humana

Abstract

Del hecho de la no prohibición del suicidio, no puede deducirse que un sujeto no pueda disponer de su propia vida, ni tampoco que el suicidio no sea un acto lícito, como ya vengo manteniendo en diversos trabajos anteriores. Pienso que existe un derecho, siquiera sea limitado ante terceros, según las situaciones que establecen el art. 143 CP y la Ley de eutanasia de 2021, a la disponibilidad de la propia vida, y en este sentido y desde este plano jurídico penal, el bien jurídico que representa el objeto de protección puede tener carácter disponible, y es este extremo y su razonamiento teórico sobre la base constitucional lo que da sentido a este trabajo. ---------------------------------------------------------------------------------------------------------

It cannot be deduced that a subject cannot dispose of his or her own life only from the fact that suicide is not prohibited; nor that suicide is not a lawful act, as I have maintained in several previous works. I think that there is a right, even if it is limited before third parties, according to the situations established by article 143 CP and the Euthanasia Act of 2021, to the availability of one’s own life, and in this sense and from this criminal legal plane, the legal property that represents the object of protection can have an available character, and it is this extreme and its theoretical reasoning on the Spanish Constitutional basis that gives meaning to this paper.
