El recurso de casación laboral

Abstract

El recurso de casación laboral se define como un medio de impugnación extraordinario del que conoce el Tribunal Supremo (Sala de lo Social). Se interpone exclusivamente por los motivos tasados en la Ley y contra las resoluciones judiciales expresamente previstas por ella. El recurso centra sus objetivos en la defensa de la ley y defensa del “ius litigatoris” en materias de trascendencia colectiva (con competencia de instancia del Tribunal Supremo de Justicia o de la Audiencia Nacional). La casación laboral es un recurso extraordinario cuyo propósito básico consiste en la defensa del ordenamiento jurídico, así como la uniformidad de la jurisprudencia, y todo ello tutelando los derechos de los litigantes al resolver el conflicto litigioso planteado.

_________________________________________________The right to labour appeal has been defined as an extraordinary means of recourse, heard by the Hihg Court, against the Rulings decreed at one single instance by the Social Divisions of the Hihg Courts of Justice and by the Social Division of the National Court. We find ourselves considering an extraordinary type of appeal due to various issues. It does not apply against all decisions. It can only be lodged in the cases authorised by law. It fails to consent to the examination of other issues apart from those raised in the grounds for appeal. It does not accept the consideration of issues not originally proposed or issued (new issues). The disapproving of the facts and the consideration of the evidence heard is prohibited-with the sole exception of a factual error in the consideration of the evidence-and restricts the decision-making powers of the appeal bodies.
