El favor libertatis como clave hermenéutica del canon 223

Abstract

Este artículo presenta una reflexión sobre los límites que los derechos de libertad poseen en el vigente Derecho Canónico codicial, en particular mediante un análisis del canon 223 CIC 83 en el proceso de su formación, en sus problemas de exégesis y a la luz de las aclaraciones del Pontificio Consejo para los Textos Legislativos. Se aportan propuestas de futuro en los actuales momentos de balance a los treinta años de la promulgación del Código de Derecho Canónico de 1983. En particular, se subraya la necesidad de tener en cuenta el principio de máxima libertad de la declaración conciliar Dignitatis humanae, n. 7. Abstract: This paper studies the limits that the rights of freedom possess in present Canon Law, especially by means of an analysis of canon 223 CIC 83 in the iter of its formation, in its problems of exegesis and in the light of the clarifications of the Pontificium Consilium de Legum Textibus. Offers of future are contributed in the current moments of balance sheet thirty years after the promulgation of the Code of Canon Law of 1983. In particular, the need to bear the principle of maximum freedom (Ecumenical Council Vatican II, Dignitatis humanae 7) is underlined.
