Responsabilidad penal y responsabilidad política: elementos para la diferenciación y la confluencia

Abstract

Se analizan las diferencias estructurales entre la responsabilidad política y la responsabilidad penal, especialmente en cuanto a su fundamento y sus fines. El carácter objetivo de la responsabilidad política, también por hechos ajenos, lleva a plantear algunos límites a partir de la comparación con la culpa civil extracontractual, con la que comparte algunos elementos. Sin embargo, el principal límite debe ubicarse en la prohibición constitucional de arbitrariedad. Se analizan también las relaciones entre ambas clases de responsabilidad cuando concurren en un mismo sujeto.

This paper analyzes the difference between criminal and political responsibility, mainly with regard to their foundation and purposes. The objective character of the politic responsibility, also by vicarious liability, lead us to put some limits when compare it with non-contractual civil fault, because both are sharing some elements. However, the mainly limit should be placed in the constitutional ban of arbitrary procedure. Also are analyzed the relationship between both kind of responsibility when two of them are found in the same individual.
