Abstract
Con la realización del presente trabajo, que supone una continuación del
anterior, pretendemos investigar sobre la importancia actual de aplicar el método del
caso a la enseñanza del Derecho Romano, frente a las tradicionales clases teóricas y
magistrales. Incidiendo, especialmente, en el alcance de las exigencias metodológicas
surgidas con los nuevos planes del estudio del Grado en Derecho en el marco del EEES;
así como en el desarrollo de una serie de competencias generales y específicas en los
estudiantes, que les van a ser muy útiles una vez que finalicen el Grado y se enfrenten a
las dificultades del mercado de trabajo actual, ya que se consideran como los verdaderos
protagonistas del proceso de enseñanza-aprendizaje. Por tanto, con la puesta en práctica
de este segundo caso, que ahora versa sobre el reparto de la herencia y la cautividad de
guerra, tratamos nuevamente de acercar al alumnado al casuismo jurisprudencial
romano afianzando las ideas vistas previamente; de este modo, comprenderán que lo
importante no es dar la solución al supuesto planteado sino razonar jurídicamente
consiguiendo, a través de debates en grupo y el trabajo personal, un conocimiento más
profundo de las reglas e instituciones aplicables.
With the accomplishment of the writing, wich representing a continuation of the previous, we pretend to investigate what the current importance of applying the case method in the teaching of Roman Law, against the traditional theoretical and magistral classes. Influencing, especially, in the reach of the methodological requirements emerged with the new plans of study Law Degree under the EEES; as well, in the development of a set of general and specific skills in students, that will be very helpful once time they finish the Degree and face the difficulties of today's labor market, because they are the true protagonists of the teaching and learning process. Therefore, with the implementation of this second case, wich now affects to the division of the inheritance and captivity for the war, once again we try to approach the students to casuism roman jurisprudence completing the ideas seen in the previous practice; in this way, they will understand that the important thing is not to give the solution to case proposed but legal reasoning, through discussions in groups and personal work, getting a deeper knowledge of applicable rules and institutions.
