Abstract
A lo largo de los años se han producido cambios en la organización del trabajo y en las
formas de trabajo, pero uno de los avances más llamativos ha sido la aparición de las plataformas
digitales online que mediante la contratación on demand o crowdsourcing han modificado la forma
clásica de prestar servicios. la regulación legal no se ha adaptado con tanta rapidez a esta nueva
realidad lo que ha originado dudas acerca de la laboralidad de estas nuevas formas de empleo;
incluso ha hecho pensar a parte de la doctrina científica sobre la idoneidad de crear una tercera
categoría o bien una nueva relación laboral especial. En este trabajo se analizarán las notas de
laboralidad y se abordarán tres pronunciamientos judiciales (deliveroo, take Eat Easy vs glovo) con
el fin de determinar si puede calificarse de laboral la relación existente entre la empresa y los
trabajadores que prestan sus servicios para este tipo de plataformas digitales

In this study reference will be made to the characteristic notes of the employment relationship and three judicial pronouncements will be studied (deliveroo, take Eat Easy vs. glovo) in order to determine whether there is work or not in the provision of services in these new business models or if it is necessary to create or modify the existing legal regulation
