El trabajo en las plataformas digitales: pronunciamientos y opiniones divergentes respecto a su calificación jurídica

Abstract

A lo largo de los años se han producido cambios en la organización del trabajo y en las formas de trabajo, pero uno de los avances más llamativos ha sido la aparición de las plataformas digitales online que mediante la contratación on demand o crowdsourcing han modificado la forma clásica de prestar servicios. la regulación legal no se ha adaptado con tanta rapidez a esta nueva realidad lo que ha originado dudas acerca de la laboralidad de estas nuevas formas de empleo; incluso ha hecho pensar a parte de la doctrina científica sobre la idoneidad de crear una tercera categoría o bien una nueva relación laboral especial. En este trabajo se analizarán las notas de laboralidad y se abordarán tres pronunciamientos judiciales (deliveroo, take Eat Easy vs glovo) con el fin de determinar si puede calificarse de laboral la relación existente entre la empresa y los trabajadores que prestan sus servicios para este tipo de plataformas digitales

Over the years there have been changes in the organization of work and ways of working but one of the most striking advances has been the emergence of digital platforms that through on-demand contracting or crowdsourcing have modified the classic way of providing services. the legal regulation has not adapted so quickly to this new reality which has led to doubts about the work or not of these new forms of employment; It has even led to think in part of the scientific doctrine about the suitability of creating a third category or a special employment relationship. In this study reference will be made to the characteristic notes of the employment relationship and three judicial pronouncements will be studied (deliveroo, take Eat Easy vs. glovo) in order to determine whether there is work or not in the provision of services in these new business models or if it is necessary to create or modify the existing legal regulation
