Abstract
O actual sistema de financiamento regional na
Espanha, que teve o seu início em 2002, é o resultado
de um acordo entre o Estado e todas as
Comunidades Autónomas e demonstra um desejo
de continuidade, tal como o comprova o facto de
o mesmo ter tomado a forma de Lei e de ter uma
duração ilimitada.
Actualmente, contudo, está aberto um novo debate
acerca da reforma do sistema, como consequência
tanto de aspectos intimamente relacionados com as
suas características internas (tais como o aumento,
de forma heterogénea, da população nas diferentes
Comunidades Autónomas), como de aspectos
externos, tais como a aprovação de novos Estatutos
Autónomos, que podem afectar não apenas o financiamento
das mencionadas Comunidades
Autónomas, mas todo o sistema em si próprio.
Em função disso, analisamos neste artigo o
enquadramento constitucional do sistema
espanhol de financiamento autonómico e
expomos os princípios constitucionais que
regulam esse financiamento.
The present system of regional financing in Spain, starting in 2002, is the product of an agreement between the State and all the Comunidades Autónomas and shows a desire for permanence as the fact of taking the form of a Law and establishing an indefinite duration corroborates. Currently, however, a new debate on the reform of the system is open as a consequence both of events closely connected to its own internal features (such as the rise of population in a heterogeneous way in the different Autonomous Communities) and of external events, such as the approval of new Autonomous Statutes that can affect not only the financing of the aforementioned Autonomous Communities but the whole system in itself. Due to this, in this article the constitutional frame of the Spanish system of autonomous financing is analysed and the constitutional principles governing that financing are exposed
