Abstract
Tras más de una década de la reforma de 2012, que afectó al despido reduciendo notablemente la cuantía de las indemnizaciones por despido improcedente, ha llegado el momento de reflexionar sobre la eficacia protectora del trabajador de dicha regulación. La conclusión es la necesidad de incrementar la tutela del trabajador, pues dicha reforma supuso una alteración en el objetivo de la normativa sobre despido, que lejos de configurarse como un mecanismo de tutela del trabajador, se ha convertido en un mecanismo para facilitar la extinción al empresario.
After more than a decade of the 2012 reform, which affected dismissal by significantly reducing the amount of compensation for unfair dismissal, the time has come to reflect on the protective effectiveness of said regulation for workers. The conclusion is the need to increase the guardianship of the worker, since said reform implied an alteration in the objective of the regulations on dismissal, which, far from being configured as a mechanism of guardianship of the worker, has become a mechanism to facilitate the extinction of the employer.
